1. About these terms
These terms govern your use of the Digiloom Solutions website at digiloom-solutions.vercel.app (the "Site"). By using the Site you accept them. If you do not accept them, please do not use the Site.
The Site is operated by Digiloom Solutions, an unregistered venture based in Bizerte, Tunisia. Because it is not yet a registered company, no RNE or matricule fiscal number applies. In these terms we call the operator "Digiloom Solutions", "we", or "us". You can reach us at digiloom.solutions@gmail.com.
2. Changes to these terms
We may update these terms. The version in force is always the one published on this page, and the date at the top shows when it last changed. If a change is significant we will note it on the Site. Continuing to use the Site after a change means you accept the updated terms.
3. Using this site
You agree to use the Site lawfully. In particular, you agree not to:
- interfere with the operation, security, or availability of the Site
- attempt to gain access to any part of the Site, its server, or connected systems that is not intended to be public
- use automated tools to collect content from the Site beyond what our robots.txt allows
- send us content through the enquiry form that is unlawful, defamatory, infringing, or malicious
- use the enquiry form for unsolicited advertising
- copy or republish Site content beyond what section 4 permits
We may restrict or withdraw access to the Site where we reasonably believe these terms have been breached.
4. Intellectual property
The Digiloom Solutions name and mark, and the design, text, and code of this Site, belong to us or to our licensors. You may view the Site and print or download pages for your own reference. Any other use, including copying the design or republishing the text, needs our written permission first.
Fonts on the Site are used under the SIL Open Font License, and three.js is used under the MIT licence. Those licences cover those components only, not the rest of the Site.
Work we produce for a client is dealt with in that client's contract, not here. Our standard position is described on the home page: the client ends up owning what we make for them.
5. Enquiries you send us
When you send an enquiry you confirm that the information in it is accurate and that you are entitled to share it with us. Do not send confidential material, personal data about other people, or anything commercially sensitive through the form. If you need to share something confidential, email us first and we will agree how to handle it.
Sending an enquiry does not create a contract between us and does not oblige either of us to go further. What we do with the personal data in your enquiry is set out in our Privacy Policy.
6. Our services, and what this site is not
The Site describes the services Digiloom Solutions offers. It is not an offer capable of acceptance, it does not include prices, and nothing on it forms a contract. Any engagement begins only when we and the client have agreed a written scope covering what is included, what is not, what it costs, and the timetable, and both sides have signed it.
Descriptions of how a project runs are a statement of our normal practice. The terms of any particular project are the ones written in that project's agreement, and where the two differ, that agreement takes precedence.
7. Third-party links and services
The Site links to third-party pages, currently the Wikimedia Commons pages that credit the photographs. We do not control those sites and are not responsible for their content or their practices. Their own terms apply when you visit them.
8. Availability
We aim to keep the Site available and correct, but we do not guarantee that it will be uninterrupted, error free, or free of harmful components. We may change, suspend, or withdraw any part of the Site without notice.
9. Disclaimers
The Site and its content are provided as they are. To the fullest extent the law allows, we exclude implied warranties of any kind, including fitness for a particular purpose. Content on the Site is general information about what we do. It is not professional advice, and you should not act on it without talking to us or to another suitable adviser about your own situation.
10. Liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, data, or goodwill, arising from your use of the Site or from your inability to use it.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law that applies, including liability for death or personal injury caused by negligence, and liability for fraud. Beyond that, no fixed cap on total liability is set here; this is worth revisiting with a lawyer before the site goes live.
11. Privacy
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
12. Governing law and disputes
These terms and any dispute arising from them are governed by the law of Tunisia. The courts of Bizerte have jurisdiction, except where the law that protects you as a consumer in your own country of residence gives you the right to bring proceedings there instead.
If you are unhappy with something, please write to us first. Most things are quicker to fix by email than by anything else.
13. General
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right immediately, that is not a waiver of it. These terms and the Privacy Policy are the whole agreement between you and us about the Site.
